Oregon’s state constitution prohibits caps on non-economic damages in personal injury cases, but it caps non-economic damages in wrongful death cases at $500,000, including wrongful deaths caused by medical malpractice. Non-economic damages include pain and suffering, loss of consortium, loss of care and guidance, and other losses. Damages for monetary losses like lost wages and medical bills are known as “economic” damages, and no cap applies to this kind of compensation.
Liability limits of $1 million per occurrence or claim and $3 million per annual aggregate are the typical policy amounts when purchasing medical malpractice insurance in Oregon. OB/GYNs and surgeons might need policies with higher liability limits than this.
