Types of Professional Liability Insurance for New Hampshire Physicians

Doctors in New Hampshire can choose between these two primary types of medical malpractice insurance:

  • Provides coverage for incidents that occurred during the policy period, IF the claim is filed while the policy is still active. If a claim is filed after the policy has ended, that claim is NOT covered.
  • Typically, it offers lower premiums at the start of the policy, but rates increase yearly as the policy matures.
  • Physicians must obtain tail insurance coverage when a claims-made policy ends to ensure protection against future claims related to incidents that occurred during the policy period. Tail insurance premiums require a one-time cash payment to the expiring carrier equal to approximately 200% of the claims-made policy’s annual premium.
  • New Hampshire physicians may opt to purchase nose coverage, or prior acts coverage, instead of tail coverage. Nose coverage can be purchased through a new carrier to protect physicians from claims that occurred before the effective date of the new policy, back to a specified date.
  • Provides coverage for incidents that occurred during the policy period, regardless of when a claim is reported to the carrier.
  • Typically, it offers more costly premiums at the start of the policy, but the rate stays constant throughout the policy’s duration.
  • Physicians do not need tail coverage when an occurrence policy ends.

Does New Hampshire Have Damage Caps for Medical Malpractice Lawsuits?

Unlike many other states, New Hampshire does not impose economic or non-economic damage caps in medical malpractice cases after the New Hampshire Supreme Court ruled that damage caps violated equal protection.

  • Punitive Damages: Not allowed in New Hampshire.
  • Burden of Proof: Plaintiffs carry the burden of proof in New Hampshire malpractice cases. They must show, with affirmative evidence and testimony from a qualified medical expert in the same specialty, that the provider breached the accepted standard of care and that the breach caused the injury.
  • Comparative Fault: Juries assign responsibility in proportion to each party’s fault. A defendant found more than 50% at fault can be held jointly and severally liable for the entire award, while a defendant under 50% at fault is only liable for their share.

New Hampshire Statute of Limitations for Medical Malpractice Claims

New Hampshire Statute 507-C:4 declares a 2-year statute of limitations for medical malpractice cases, with few exceptions. However, RSA 507-C has been subject to repeated constitutional challenges for violating the U.S. Equal Protection Clause by singling out medical malpractice plaintiffs from general personal injury plaintiffs, who have 3 years from the date of injury (or date of discovery) to file their case in court.
