Types of Professional Liability Insurance in Florida

Physicians in Florida can choose between these two primary types of medical malpractice insurance:

  • Provides coverage for incidents that occurred during the policy period IF the claim is filed while the policy is still active. If a claim is filed after the policy ends, that claim is NOT covered.
  • Typically, it offers lower premiums at the start of the policy, but rates increase yearly as the policy matures.
  • Physicians need to obtain tail insurance coverage when a claims-made policy ends to ensure protection against future claims related to incidents that occurred during the policy period. Tail insurance premiums require a one-time cash payment equal to approximately 200% of the claims-made policy annual premium.
  • Provides coverage for incidents that occurred during the policy period, regardless of when a claim is reported to the carrier.
  • Typically, it offers more costly premiums at the start of the policy, but the rate stays constant for the entire policy length.
  • Physicians do not need tail coverage when an occurrence policy ends.

Are There Medical Malpractice Caps on Damages in Florida?

There are no limitations on economic or non-economic damages. In 2017, the Florida Supreme Court ruled damage caps unconstitutional, arguing that limiting plaintiff payouts would violate equal protection rights.

Punitive damages are subject to the following parameters, depending on the context of a provider’s wrongful conduct:

  • Intent to Harm: No cap.
  • Gross Negligence: Not to exceed the greater of $500,000 or 3x the total compensatory damages.
  • Motivated by Financial Gain: Not to exceed $2 million or 4x the total compensatory damages.

Statute of Limitations for Medical Malpractice in Florida

According to the Florida Comprehensive Medical Malpractice Reform Act, an action for medical malpractice damages shall be filed within:

  • 2 years of injury or death.
  • No more than 4 years after the alleged malpractice.
  • 7 years IF the case involves fraud, concealment, or intentional misrepresentation.

Exception:

  • The limitations for minors aged eight or younger do not apply for claims filed by the claimant’s 8th birthday.

What are the Florida requirements for medical malpractice insurance?2025-11-11T00:44:18-06:00

Florida law does not require all physicians to carry malpractice insurance, but it does require proof of financial responsibility in the event of a claim.
Physicians can meet this requirement by:

  • Purchasing malpractice insurance with minimum limits of $100,000 per claim / $300,000 aggregate, or
  • Posting a surety bond or escrow account for the same amount.
Most hospitals, surgery centers, and medical groups still require active malpractice coverage, which is where MEDPLI helps physicians find affordable, compliant policies.
Do Florida malpractice insurance policies include tail coverage?2025-11-11T00:45:40-06:00

Tail coverage is not automatically included in most Florida malpractice insurance policies. It’s required when you have a claims-made policy and you leave your practice, switch insurers, or retire, to protect against claims filed later.

Tail coverage typically costs 150%–250% of your annual premium as a one-time payment.

MEDPLI helps doctors compare tail options and find the most cost-effective way to stay protected after policy termination.
