Florida Medical Malpractice Payouts From 2015-2023
Types of Professional Liability Insurance for Florida Physicians
Physicians in Florida can choose between these two primary types of medical malpractice insurance:
- Provides coverage for incidents that occurred during the policy period IF the claim is filed while the policy is still active. If a claim is filed after the policy ends, that claim is NOT covered.
- Typically, it offers lower premiums at the start of the policy, but rates increase yearly as the policy matures.
- Physicians need to obtain tail insurance coverage when a claims-made policy ends to ensure protection against future claims related to incidents that occurred during the policy period. Tail insurance premiums require a one-time cash payment equal to approximately 200% of the claims-made policy annual premium.
- Provides coverage for incidents that occurred during the policy period, regardless of when a claim is reported to the carrier.
- Typically, it offers more costly premiums at the start of the policy, but the rate stays constant for the entire policy length.
- Physicians do not need tail coverage when an occurrence policy ends.

Does Florida Have Damage Caps for Medical Malpractice Lawsuits?
In Florida, there are no limitations on economic or non-economic damages. In 2017, the Florida Supreme Court ruled damage caps unconstitutional, arguing that limiting plaintiff payouts would violate equal protection rights.
Punitive damages are subject to the following parameters depending on the context of a provider’s wrongful conduct:
- Intent to Harm: No cap.
- Gross Negligence: Not to exceed the greater of $500,000 or 3x the total compensatory damages.
- Motivated by Financial Gain: Not to exceed $2 million or 4x the total compensatory damages.
Florida Statute of Limitations for Medical Malpractice Claims
According to the Florida Comprehensive Medical Malpractice Reform Act, an action for medical malpractice damages shall be filed within:
- 2 years of injury or death.
- No more than 4 years after the alleged malpractice.
- 7 years IF the case involves fraud, concealment, or intentional misrepresentation.
Exception:
- The limitations for minors aged eight or younger do not apply for claims filed by the claimant’s 8th birthday.
