Maryland: Medical Malpractice Insurance Requirements for 2023
Maryland physicians are not legally required to carry medical malpractice insurance. If a physician chooses to forego coverage, they are required to notify their patients in writing at the time of the patient’s first visit, and as part of obtaining the patient’s informed consent for any procedure or surgery, that they lack medical malpractice insurance. Maryland physicians are also required to post their lack of medical malpractice insurance coverage in their place of practice.
However, Maryland physicians are required to carry medical professional liability insurance limits of $1 million per occurrence or claim and $3 million per annual aggregate to obtain hospital credentialing and to participate in health plans in Maryland.
